Encroachment Permit Application & Process

The applicant shall review and download the Encroachment Agreement Application (major or minor) and provide the preliminary information requested, which includes the following:

  • Recitals - Item 4: Property Description w/tentative construction/access schedule.
  • Recitals – Item 5: Existing District Facility Description
  • Recitals – Item 6: Description of proposed work to be done within the District right-of-way, on District-owned land and/or a District easement, or to District Facility.
  • Agreement – 15.a: Applicant Information
  • Agreement – Signatory information
  • Exhibit A – Property Legal Description and Map
  • Exhibit B – Proposed Construction Documents for District Facilities
  • Exhibit C – If dewatering or any surface flows may be generated by a project and discharged into the District’s Facilities, the Noice of Applicability (NOA) General Waste Discharge Requirement Order permit for Dischargers to Surface Water and/or a State Water Resource Control Board approval document shall be submitted

    The Encroachment Permit application, review, and approval process will follow the steps listed below:

    1. The applicant will submit a completed Encroachment Agreement Application, which includes all Exhibits A – C, to the Pescadero Reclamation District No. 2058 District Engineer by email (nprichard@gkengineers.com).
    2. The District Engineer will contact the applicant to discuss the project and the required deposit to cover the legal, administrative, and engineering review of the Encroachment Agreement Application, improvement plans, and right-of-way documents.  A copy of the fee schedule is 
    3. The District Engineer, Counsel, and Staff will review the submitted Encroachment Agreement Application and draft an Encroachment Agreement that reflects the project specifics provided.  
    4. The District Engineer will review the submitted Construction Documents (Exhibit B) to ensure that the submitted improvement plans correspond with the District’s Improvement Standard Drawings. 
    5. An Encroachment Agreement and final Exhibits will be presented to the Board of Trustees for approval at a publicly noticed Board meeting. 
    6. The District Engineer and Inspector will conduct construction inspections for all construction activities related to the District Facility, whether existing or proposed.  Inspections are generally not required for Minor Encroachment Permits, but can be depending on the project and whether requested by the applicant.

    Notes

    An Encroachment Agreement will not be approved by the District Engineer and submitted to the District’s Board of Trustees for approval until all Exhibits (legal description, construction documents/site map, and Stormwater documents, if applicable, are finalized and accepted by both the District Engineer and Staff.

    District Engineer and Staff will make themselves available for applicant-requested site visits, whether such visits are for project development, design, and/or pre-construction.

    The District’s Board of Trustees generally meets on the first Wednesday of each month. 

    Insurance Requirements

    Applicants must secure and maintain, in full force and effect until the satisfactory completion and acceptance of a project, insurance to protect both the applicant and the District.  The Encroachment Agreement Application specifies the requirements for insurance.  Generally, applicants must have the following insurance coverage:

    • Commercial General Liability insurance with a combined single limit of not less than one million dollars ($1,000,000) per occurrence or claim and two million dollars ($2,000,000) aggregate; and
    • Commercial Automobile Liability insurance with a combined single limit for bodily injury and property damage of not less than one million dollars ($1,000,000.00) for each occurrence for any owned, hired or non-owned vehicles.

    All applicants must provide the Certificates of Insurance and endorsements verifying their insurance coverage required by their Encroachment Permits. 

    Permit Duration

     A District Encroachment Permit is valid until the approved date of a project’s completion, or upon expiration of insurance coverage, whichever occurs first.  Applicants must submit a Notice of Completion to the District to initiate the Encroachment Permit termination process.
